General Terms and Conditions (GTC)

1. Provider and Scope
These General Terms and Conditions (GTC) apply to orders
placed via the online shop hawlik.ch as well as, where applicable, to
orders placed by telephone or by other individual means with
Nutrexin AG.

The GTC apply to both private customers
(B2C) and business customers
(B2B), in particular specialist retailers, therapists,
and other commercial purchasers.
Individual terms may be agreed for business customers. Such individual agreements, particularly regarding
prices, discounts, minimum quantities, payment or delivery terms,
take precedence over these GTC.
2. Offer and Products
The range available in the online shop at any given time is authoritative.
Images, product descriptions, and other representations are for
illustrative purposes. Minor deviations in appearance,
packaging, or presentation remain reserved, provided that the
essential characteristics of the product are not changed.
The information about the products in the online shop is compiled with the greatest possible
care. The information on the respective product packaging is definitive.
Availability of the offered products remains reserved.
Should a product be unavailable after an order has been completed,
the customer will be informed. Payments already made for unavailable products will be
refunded.
3. Ordering and Conclusion of Contract
Before completing an online order, the entered data
and selected products can be checked and corrected.
By submitting the order, the customer places a binding order.
Receipt of the order will be confirmed electronically.
Nutrexin AG reserves the right to reject or cancel orders, particularly in cases of obvious price or product errors, lack of availability, or justified suspicion of misuse.
For orders placed by telephone or individually, the contract is concluded in accordance with the respective agreement between
Nutrexin AG and the customer.
4. Prices, Discounts, and Shipping Costs
The prices in Swiss Francs (CHF) indicated in the online shop at the time of the order apply. Prices include the legally required value-added tax, if applicable.
Deliveries within Switzerland and to Liechtenstein are free of shipping costs.
Promotional prices, discount codes, and other benefits are subject to the communicated conditions. Unless expressly stated otherwise, discount codes cannot be combined with one another and cannot be applied retroactively to already completed orders.
For product bundles, the prices and conditions stated in the online shop for the respective offer apply.
5. Payment Terms
The payment methods available in the online shop are displayed during the order process. Payment processing can be carried out via external payment service providers.
For orders placed by telephone, delivery against invoice can be arranged by agreement. Unless otherwise agreed, the payment period is 30 days from the invoice date.
Statutory provisions apply in the event of late payment.
6. Delivery, Delivery Area, and Delivery Time
Deliveries are made exclusively within Switzerland and to Liechtenstein.
The usual delivery time is 2–3 working days. Unless expressly agreed otherwise, the stated delivery time does not constitute a guaranteed delivery deadline.
Delivery is made to the delivery address provided by the customer. The customer is responsible for the accuracy and completeness of the address information.
If there are special delivery agreements between the customer and the respective transport service provider, such as a drop-off authorization, delivery may be made in accordance with these agreements.
7. No Voluntary Right of Withdrawal, Return, or Exchange
Nutrexin AG does not grant a voluntary right of withdrawal, return, or exchange.
Products that have been properly delivered and are free of defects cannot, therefore, generally be returned or exchanged. This applies in particular to food and dietary supplements.
Statutory claims for defective or incorrectly delivered products, as well as claims in connection with product recalls or mandatory statutory provisions, remain reserved.
8. Inspection of Delivery, Incorrect Deliveries, and Defects
The customer is requested to inspect the delivery upon receipt for completeness, obvious transport damage, incorrect deliveries, and visible defects, and to report any complaints to Nutrexin AG as soon as possible.
In the event of a proven incorrect delivery or a justified defect, Nutrexin AG will generally provide a replacement, provided this is possible and legally permitted.
If a replacement delivery is not possible or unreasonable, further claims shall be governed by the applicable statutory provisions.
9. Warranty
Statutory warranty provisions apply to defects, insofar as these GTC do not provide for otherwise permissible regulations.
In the case of justified defects, Nutrexin AG is generally entitled to provide a replacement delivery, provided this is possible and reasonable for the customer. Mandatory statutory claims remain reserved.
Excluded from the warranty are damages or impairments caused in particular by improper storage, improper use, or non-observance of product and usage instructions after the product has been handed over.
10. Food and Product Safety / Product Recalls
Statutory provisions regarding food and product safety remain fully reserved.
Should a recall or safety-related information be required for a product, Nutrexin AG may inform the affected customers via the contact details provided during the order, insofar as this is necessary and permitted.
Instructions in connection with product recalls or safety information must be followed.
11. Notes on Dietary Supplements
Dietary supplements are not a substitute for a varied and balanced diet and a healthy lifestyle.
The consumption recommendations, warnings, and storage instructions stated on the product packaging must be observed. The specified recommended daily intake must not be exceeded.
In case of special personal circumstances or uncertainties regarding the use of a product, the respective product information should be observed and a suitable professional consulted if necessary.
12. Retention of Title
The delivered goods remain the property of Nutrexin AG until payment has been made in full, to the extent permitted by law.
13. Liability
Nutrexin AG is liable in accordance with the applicable statutory provisions.
To the extent permitted by law, liability is excluded for damages resulting from improper use or storage of the products, failure to follow product or usage instructions, or circumstances beyond the control of Nutrexin AG.
Liability for intent and gross negligence, as well as for cases of liability that may not be excluded or limited under mandatory law, remains reserved.
14. Data Protection
Personal data will be processed in accordance with the applicable data protection laws. Further information on the processing of personal data can be found in the privacy policy at hawlik.ch.
15. Copyright and Intellectual Property
The content of the online shop, in particular texts, images, graphics, logos, and other design elements, are protected by copyright and/or trademark law. Use beyond what is legally permitted requires the consent of the respective rights holder.
16. Force Majeure
To the extent permitted by law, Nutrexin AG is not liable for delays or failure to perform contractual obligations resulting from events beyond its reasonable control.
17. Changes to the GTC
Nutrexin AG may change these GTC with effect for future orders. The version applicable at the time of the conclusion of an order is authoritative for that order.
18. Severability Clause
Should any provision of these GTC be invalid or unenforceable in whole or in part, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
19. Applicable Law and Place of Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as its exclusion is permitted.
The legally provided places of jurisdiction apply to consumers.
For business customers, the place of jurisdiction is Zurich, to the extent permitted by law.
